Governor can’t remove ‘plagiarists’: apex court

LAHORE, Dec 22: A threemember full bench of the Supreme Court on Wednesday reinstated two assistant professors of the Centre for High Energy Physics (CHEP), Punjab University, who were removed for alleged plagiarism.
The bench, headed by Chief Justice of Pakistan Iftikhar Muhammad Chaudhry, held that the appellants/assistant professors were removed by the governor in his capacity as chancellor of the university. The court observed that the governor was not a competent authority to remove them from the service.
The CJP held that the university did not adopt legal course of proceedings against the appellants as the university authorities were at liberty to hold departmental proceedings against them.
Appellants Maqsood Ahmed and Alam Saeed through their counsel pleaded that the university authorities did not follow the due legal course while removing them from service.
They said the vice-chancellor had sought assistance from the syndicate which recommended seizure of two increments each only.
They said the syndicate did not impose fine on them holding that there was not a settled pattern in this regard to evaluate the plagiarists. But the chancellor went beyond the limits and instead of seizing their increments, removed them from service for which he was not competent.
